Columbia Valley Vacations Booking Confirmation Terms and Conditions Our reservations team would like to thank you for choosing Columbia Valley Vacations for your holiday needs. We appreciate your business and welcome your feedback. We ask that you please take a moment to read your confirmation in full to ensure that it is correct and that you clearly understand the terms and conditions of your reservation. The addressee to whom the invoice has been presented will be the only recipient of this Booking Confirmation and Booking Confirmation Terms and Conditions and it is the sole responsibility of the addressee to inform all other parties involved in this reservation of its contents. Multiple confirmations will not be issued. As addressee you acknowledge that you are of the age of majority in your home jurisdiction and are legally able to make this booking. Please verify all the information on your confirmation for accuracy and completeness, and in particular, dates of arrival and departure, type of accommodation, the number of children and adults authorized to occupy the accommodation, the quantity and type of additional services and the spelling of names and addresses. Occupancy of the unit is restricted to those authorized by this confirmation. Unless specifically stated in your confirmation, no pets are allowed in or on the accommodation property. Late arrival, early departure, or termination of occupancy for cause by our supplier, shall not entitle you to a refund of any monies paid. CVV reserves the right to transfer your booking to an equivalent accommodation, at its discretion, because the reserved property becomes unavailable due to circumstances beyond its control. Therefore, we cannot absolutely guarantee a specific unit code at all times. Where possible you will be given prior notification, however, in some instances this may not be possible. If you have not already done so it is recommended that you purchase travel insurance to protect you if you are forced to cancel your booking due to unforeseen circumstances. If you have purchased travel insurance please refer to the actual policy that you will receive by mail for specific coverage. In making your booking you agree that CVV and their suppliers are separate and distinct entities and that no joint venture, partnership, employment, or agency relationship exists between you and CVV or their suppliers as a consequence of this booking or the use of the CVV website. The contract entered into by CVV with its suppliers obligates them to honor their obligations to you in a satisfactory manner or risk the termination or suspension of their participation as an accommodation provider through CVV. While CVV makes every effort to insure that the information provided by its suppliers is accurate and complete as of the date of your reservation, CVV expressly disclaims any liability for inaccuracies, incomplete, or misleading information provided by the suppliers to CVV. You agree to abide by the terms and conditions imposed by the suppliers and to be completely responsible for any additional charges, fees, duties, taxes, and assessments that you may incur directly with the supplier. You hereby consent to the exclusive jurisdiction of the courts of British Columbia in adjudicating any and all disputes arising out of or relating to your use of the CVV website and in the making of this or any other booking as a consequence thereof. The laws of British Columbia shall be the applicable law with respect to any such dispute. If any part of this agreement is determined to be invalid or unenforceable, the invalid or unenforceable provision shall be deemed superseded by a valid and enforceable provision that most closely matches the intent of the original provision and the agreement so modified shall continue in effect. CVV shall not be liable for any claims, losses, damages, costs, expenses, delays, or loss of enjoyment, or consequential damages, of any nature or kind whatsoever, to you or your traveling companions or other group members, resulting from events beyond our or our supplier's reasonable control. This includes, but is not limited to, acts of God, strikes, lockouts or other labor disputes or other disruptions, blockades, war, terrorism, insurrections, riots, earthquakes, avalanches, floods, road conditions or closures, snow conditions, snow cover for ski-in or ski-out access, lift closures or number of runs open, or acts or restraints imposed by government authorities. In addition, CVV and their suppliers shall not be liable for any direct or indirect, punitive, incidental, special or consequential damages arising out of the use of the CVV website or this booking whether based in contract, tort, and strict liability or otherwise, even if CVV and its suppliers have been advised of the possibility of damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential damage or incidental damages, the above limitation may not apply to you. CVV and their suppliers make no representations about the suitability of products and services provided by its website and this booking. The CVV Cancellation Policy as stated above applies equally to all services being provided by this Booking Confirmation, including but not limited to, accommodation, green fees, lift tickets, shuttle services, and golf, ski or snowboard lessons. Payment by you of advance deposits and subsequent payments, whether by cash, certified cheque, draft, or credit card, constitutes your acceptance and confirmation of these Terms and Conditions and Cancellation Policies, and in particular, constitutes your authority to use the deposits and subsequent payments for cancellation charges incurred by you pursuant to the Cancellation Policy above. |
